1. Acceptance of Terms

By downloading, installing, or using the LUNA – AI Art Generator application (the "App") or visiting the website at www.lunaart.app (the "Website"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and Rocket Digital Limited ("we," "our," or "us"), a company registered in Hong Kong at 1603, The L Plaza, 367-375 Queens Road Central, Hong Kong.

If you do not agree to these Terms, do not use the App or Website.

2. Description of Service

LUNA is an AI-powered art generation application that allows users to create images from text prompts and photos using various artificial intelligence models. The App is available on iOS (Apple App Store) and Android (Google Play Store).

Features include but are not limited to:

  • Text-to-image AI art generation
  • Photo-to-art transformation
  • AI portrait and avatar generation
  • Multiple AI model selection (20+ models)
  • Various art style presets
  • High-resolution (4K) image export

3. User Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information when creating your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorized purposes.

4. Subscriptions and Payments

4.1 Free Tier

LUNA offers a free tier with limited daily generations and advertisements served through Google AdMob.

4.2 LUNA Pro Subscription

LUNA Pro is available as an auto-renewable subscription. Subscription management and payment processing are handled by Apple (for iOS) and Google (for Android) through their respective app stores, with RevenueCat managing subscription state synchronization.

  • Payment is charged to your App Store or Google Play account at confirmation of purchase.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
  • You can manage or cancel your subscription through your device's app store settings.
  • No refunds are provided for partial subscription periods, unless required by applicable law.

4.3 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will apply to the next billing cycle.

5. User Content and AI-Generated Content

5.1 Your Input

You retain ownership of the text prompts and images you submit to LUNA. By using the App, you grant us a limited, non-exclusive license to process your inputs through our AI services for the purpose of generating images.

5.2 AI-Generated Output

LUNA Pro subscribers receive full commercial usage rights to images generated through the App. Free tier users may use generated images for personal, non-commercial purposes only.

We do not guarantee that AI-generated content is unique or does not resemble existing works. You are responsible for ensuring your use of generated content complies with applicable laws.

5.3 Third-Party AI Processing

Your prompts and uploaded images are processed by third-party AI services including OpenAI, Microsoft Azure, Replicate, and Fal.ai. These services have their own terms and privacy policies that apply to their processing of your data.

6. Prohibited Uses

You agree not to use LUNA to:

  • Generate illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content.
  • Create content that exploits, harms, or endangers minors in any way.
  • Generate non-consensual intimate imagery or deepfakes of real people.
  • Create content that infringes on intellectual property rights of others.
  • Produce content designed to spread misinformation or manipulate public opinion.
  • Attempt to reverse-engineer, decompile, or extract the AI models used by the App.
  • Use automated systems, bots, or scripts to access or interact with the App.
  • Circumvent any usage limits, security measures, or access controls.
  • Resell or redistribute the App or its services without authorization.

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines without prior notice.

7. Intellectual Property

The LUNA App, Website, brand, logo, and all associated materials are the intellectual property of Rocket Digital Limited. The underlying AI models are provided by their respective owners (OpenAI, Google, Black Forest Labs, etc.) and are used under license.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without prior written consent.

8. Disclaimers

  • LUNA is provided "as is" and "as available" without warranties of any kind, express or implied.
  • We do not guarantee uninterrupted, error-free, or secure service.
  • AI-generated content may be inaccurate, biased, or unsuitable. You are solely responsible for reviewing and using generated content.
  • We are not responsible for the actions or policies of third-party AI service providers.
  • Model availability may change without notice as we add, update, or remove AI models.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Rocket Digital Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use LUNA. Our total liability shall not exceed the amount you paid for LUNA Pro in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Rocket Digital Limited, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of LUNA, your violation of these Terms, or your infringement of any third-party rights.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue LUNA (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

12. Changes to Terms

We may revise these Terms at any time. The most current version will always be available on our Website. By continuing to use LUNA after changes become effective, you agree to the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
